LExp Service Terms & Disclaimer

These Service Terms & Disclaimer apply to the use of LExp, including LExp Premium and SkyMeter Forecast.

Your use of LExp is also subject to Apple’s Standard End User License Agreement (EULA), which governs applications distributed through the Apple App Store. These terms supplement, and do not replace, the Apple Standard EULA.

LExp Premium

LExp Premium is an auto-renewable subscription that provides access to additional features within LExp, including SkyMeter Forecast.

Subscription options, duration and prices are displayed in the app before purchase. Prices may vary by country or region and are determined through the Apple App Store.

Payment is processed by Apple and charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically unless cancelled before the applicable renewal date.

You can manage or cancel your subscription through your Apple Account subscription settings. Refunds and billing issues are handled by Apple in accordance with App Store policies.

Access to Premium features remains available while your subscription is active.

SkyMeter Forecast

SkyMeter Forecast is designed as a photography planning tool. It analyses weather forecast data and atmospheric conditions to estimate the potential for colourful light around sunrise and sunset.

SkyMeter forecasts are predictions, not observations or guarantees.

Weather conditions can change rapidly, and forecast data may be inaccurate, incomplete, delayed or unavailable. Actual conditions at a location may differ substantially from those shown in LExp.

SkyMeter uses weather information supplied by third-party weather data providers, including MET Norway. LExp does not control the availability or accuracy of third-party forecast data.

SkyMeter Colour Index

The SkyMeter Colour Index (SCI) is a 1–5 photographic-potential rating derived from forecast atmospheric and cloud conditions.

SCI is an ordinal planning aid. It is not:

• a percentage chance of a colourful sunrise or sunset;
• a calibrated meteorological probability;
• a guarantee of photographic conditions; or
• a guarantee that a particular photograph or visual result will occur.

An SCI rating should therefore be used as one piece of information when deciding whether and where to photograph.

Photography Calculators and Astronomical Information

Exposure recommendations, sunrise and sunset times, twilight times, Moon information, eclipse information and other calculations provided by LExp are intended to assist with photographic planning.

Results may be affected by factors including equipment characteristics, local terrain and horizon obstructions, atmospheric conditions, weather, location accuracy and differences between theoretical and actual camera or filter performance.

You remain responsible for checking settings and conditions appropriate to your equipment and location.

When photographing or observing the Sun or a solar eclipse, appropriate solar safety equipment and procedures must be used. LExp is not a substitute for professional eye-safety or equipment-safety guidance.

Not a Safety or Emergency Service

LExp and SkyMeter Forecast are intended for photography planning.

They should not be relied upon for safety-critical decisions, emergency warnings, navigation, aviation, marine operations, severe-weather decisions or other activities where inaccurate or unavailable information could result in injury, loss or damage.

For official weather warnings and safety information, consult the relevant government or emergency service for your location.

Service Availability

We aim to keep LExp and its online-data features working reliably, but continuous availability cannot be guaranteed.

Features that depend on third-party data, network connectivity, Apple services or other external systems may occasionally be unavailable or delayed.

Features may be improved, modified or replaced as LExp develops, subject to applicable law and App Store requirements.

Intellectual Property

LExp, SkyMeter Forecast, the SkyMeter Colour Index implementation, application design, software, graphics and original content are protected by applicable intellectual property laws.

Third-party information and trademarks remain the property of their respective owners.

Limitation of Liability

To the maximum extent permitted by applicable law, LExp and its developer are not liable for losses arising solely from reliance on forecast information, photographic recommendations or calculated results provided by the app.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded or limited under applicable law.

Privacy

Use of information by LExp is described separately in the LExp Privacy Policy.

Changes to These Terms

These terms may be updated when LExp features, services or legal requirements change.

The current version will be made available through the LExp website and/or the application.
